Former Nairobi Official Sentenced to 14 Years for Land Fraud

Nairobi:The Director of Public Prosecutions (DPP) has successfully obtained a 14-year prison sentence for former Nairobi Provincial Commissioner Davis Nathan Chelogoi. This sentence comes in the wake of Chelogoi’s involvement in a fraudulent scheme concerning a 7.39-hectare parcel of land in Lower Kabete, Nairobi, valued at Sh1.35 billion.

According to Kenya News Agency, Milimani Chief Magistrate Dolphina Alego found Chelogoi guilty of six charges related to the attempted fraudulent acquisition of the land parcel Nairobi/Block/80/44, which belongs to businessmen Ashok Rupshi Shah and Hitenkumar Amritlal Raja.

Chelogoi received a two-year sentence for conspiracy to defraud, another two years for forcible detainer, three years for each of the two forgery counts, three years for uttering a forged document, and one year for procuring registration of land by false pretense. The court ordered that these sentences are to be served concurrently.

The court’s judgment revealed that Chelogoi had forged a letter of allotment dated January 31, 1995, falsely claiming it was issued by the Commissioner of Lands to assert his ownership of the property. The court also determined that on October 11, 2023, at the Directorate of Criminal Investigations (DCI) headquarters, Chelogoi knowingly presented forged documents, including a letter of allotment and a certificate with a fake signature and stamp attributed to land registrar Paul Achieng Pesa.

As part of the court’s orders, Chief Magistrate Alego instructed the Land Registrar to cancel any parallel title or registration related to the property, affirming Shah and Raja’s ownership. The prosecution, led by Sonia Njoki, Hillary Isiaho, and James Murage, presented 19 witnesses and provided documentary and expert evidence to substantiate the charges against Chelogoi.
