Eldoret: The Office of the Data Protection Commissioner (ODPC) is set to launch its fourth regional office in Eldoret, marking a significant milestone in the commemoration of Data Privacy Day 2025. The inauguration ceremony, scheduled for today, will be attended by Information, Communications, and the Digital Economy Cabinet Secretary William Kabogo.

According to Kenya News Agency, the establishment of the Eldoret office follows the successful openings of regional offices in Mombasa, Nakuru, and Kisumu. Additionally, the ODPC has extended its presence through Huduma Centres in Nyeri and Garissa, which serve as vital access points for data protection services across various regions.

The theme for the 2025 Data Privacy Day is ‘Safeguarding Personal Data to Spur Digital Transformation and Economic Development.’ Data Commissioner Immaculate Kassait emphasized the importance of aligning technological advancements with a commitment to personal data protection and fostering trust in the digital era. During a media breakfast briefing in Eldoret, she highlighted that the discussions on data privacy are crucial in driving economic development while ensuring citizen privacy.

Commissioner Kassait also stressed the role of the media in promoting understanding of personal data protection since the enactment of the Data Protection Act in 2019 and the operationalization of the ODPC in 2020. She noted the ODPC’s progress in implementing the act, including registering over 8,000 data controller processors, which indicates growing compliance with data protection regulations.

The ODPC’s sector-specific guidance efforts have been expanded to streamline data processing operations in various sectors. Eight guidance notes have been published, covering areas such as digital credit providers, communication, education, and health. The office has conducted 84 audits and inspections to ensure compliance with the Data Protection Act, 2019, and its regulations. Additionally, 192 advisories and 138 Data Protection Impact Assessments (DPIAs) have been issued.

The Data Commissioner, alongside Media Council of Kenya CEO David Omwoyo, revealed that the ODPC has received 6,817 complaints, of which 6,516 have been investigated and resolved. The office has issued 195 determinations, 100 enforcement notices, and 12 penalty notices, ensuring compliance with data protection regulations. Furthermore, 27 cases have been resolved under the Alternative Dispute Resolution framework.

Omwoyo encouraged journalists to understand the expectations from the ODPC as a regulator, particularly regarding potential malpractices by Data Controllers and Processors. He emphasized the media’s pivotal role in promoting responsible data handling practices and advocating for enhanced data privacy safeguards within society.
