Thika: The Judiciary has expressed significant concern regarding major occupational health, safety, and service-delivery issues impacting the Thika Environment and Lands Court (ELC), one of the busiest in the nation.
According to Kenya News Agency, a significant construction project near the court premises is causing dust and debris, thus degrading air quality and posing health risks to judges, staff, advocates, and court users, especially vulnerable groups such as children, the elderly, and those with respiratory conditions. This construction activity is also affecting the dignity of service expected at a court station.
Additionally, the court’s current location, housed in a facility donated by the County Government of Kiambu, is also used for parking garbage collection trucks, leading to foul odors and hygiene issues that compromise the court’s operations and public access to justice.
Winfridah Mokaya, Chief Registrar of the Judiciary, acknowledged a peaceful march by Law Society of Kenya members on February 13, 2026, aimed at raising awareness about these issues. Mokaya assured that the Judiciary considers this an urgent matter due to its implications on staff welfare, public health, institutional integrity, and the continuity of justice services.
Following a Bar-Bench meeting on February 11, 2026, the Chief Registrar highlighted two resolutions for immediate risk mitigation. The Judiciary will prioritize virtual hearings and rulings to minimize physical exposure to the unfavorable environment while maintaining access to justice. For necessary physical sittings, consultations are ongoing to find a suitable alternative venue and practical arrangements to ensure orderly scheduling and user-friendliness.
Mokaya emphasized these interim measures are intended to protect court stakeholders’ safety and wellbeing while ensuring the Court continues its constitutional mandate. A long-term solution for appropriate ELC premises in Thika is also being pursued.
A Court Users Committee meeting is scheduled for February 18, 2026, to discuss a consultative and inclusive multi-agency approach forward, involving the Judiciary, the Bar, the County Government, security agencies, and other justice sector actors. Mokaya urged LSK representatives in the CUC to fully participate to ensure practical and coordinated interventions.
