EB-5 Industry Leaders, USCIS Agree to Joint Settlement of Two Lawsuits

EB-5 stakeholders ensure all previously approved regional centers maintain authorization moving forward

WASHINGTON, D.C., Aug. 25, 2022 (GLOBE NEWSWIRE) — Multiple EB-5 industry stakeholders have entered into a settlement agreement with the United States Citizenship and Immigration Services (“USCIS”) that protects EB-5 investors and re-authorizes previously approved regional centers, effectively signaling the EB-5 program is fully back in business.

The settlement affects two cases: Behring Regional Center LLC, et al. v. Mayorkas, et al., No. 3:22-cv-2487-VC (N.D. Cal.) and EB5 Capital, et al. v. DHS, et al., No. 3:22-cv-3948-VC (N.D. Cal.). The plaintiffs include EB-5 regional center operators: EB5 CapitalCanAm EnterprisesCivitas Capital GroupGolden Gate GlobalPine State Regional Center, and EB-5IC’s member – Behring Regional Center, and industry organization Invest in the USA (“IIUSA”).

The key stipulations of the settlement – which can be read in its entirety here – are as follows:

  • Previously authorized regional centers retain their authorization.
  • Previously authorized regional centers must file a Form I-956 (a previously filed I-956 will meet this requirement) by December 29, 2022, along with the filing fee to maintain authorization.
  • Previously authorized regional centers need not wait for approval of their Form I-956 and may immediately file I-956Fs (exemplars).
  • If, after filing a form I-956F, a regional center does not receive a formal receipt notice within ten calendar days of delivery to USCIS, an investor may use other forms of proof of the I-956F filing in their I-526E petition, such as a lock box receipt, cashed check, or credit card charge provided by the regional center to the investor.
  • The failure of a previously approved regional center to file a Form I-956 application or amendment will not, standing alone, be a basis for USCIS to deny an investor’s I-526 or I-829 petition.
  • USCIS will update its website, forms, and instructions to conform to the terms of the settlement agreement.

The settlement comes in the wake of legal action taken to protect the EB-5 industry from USCIS’ decision earlier this year. After the EB-5 Reform and Integrity Act of 2022 went into effect in March, USCIS announced that all previously approved regional centers (those authorized by USCIS before the enactment of the Integrity Act) were categorically deauthorized. The Court determined that USCIS’ action almost certainly committed legal error and would have severely harmed the EB-5 industry while leaving EB-5 investors in limbo. While all parties involved have agreed to the settlement, it is not a final settlement until approved by the court.

Natembeya Pledges To Spur Economic Growth

Incoming Trans Nzoia County Governor George Natembeya has pledged to form an all-inclusive administration for effective service delivery to members of the public.
Natembeya made the promise at Kitale ASK show grounds moments after he and his Deputy Governor Philemona Binea, took oath of office on Thursday.
The swearing in ceremony, which was witnessed by hundreds of Trans Nzoia residents, including civil servants, was presided over by High Court Judge Justice Joseph Karanja and Chief Magistrate Julius Ng’arng’ar.
In his speech addressed to the public, Mr Natembeya assured members of all the 45 tribes living in Trans Nzoia of equal representation in his government both in terms of employment opportunities and County resources allocation and distribution.
To achieve a united devolved unit, the new county boss used the occasion and urged the locals to shed off tribal tags.
“One of my development goals will be to ensure Trans Nzoia, which is purely cosmopolitan, truly gains the proper face of Kenya. Thus l urge all of us to put aside our Teso, Maragoli, Bukusu, Sengwer, Saboti, Kikuyu among others tribal tags,” appealed Natembeya.
Natembeya appealed to elected leaders in the County to work as a solid unit for the sake of delivering on their pre-election pledges and most importantly spur the County’s economic growth and development.
“My passionate message to all our elected Members of County Assembly (MCAs), Members of National Assembly (MNAs), Senator and Woman Representative, is clear. This is time to subject ourselves to political party loyalty but demonstrate leadership as promised to our people in the just concluded electioneering period,” remarked Natembeya who was elected on Democratic Alliance Party of Kenya (DAP-K).
The incoming Trans Nzoia Governor partly blamed allegiance to party affiliations, especially by MCAs, for disrupting development goals in most county governments.

He singled out agriculture, transport, health and environment as some of the key development sectors the new administration would put a lot of attention and focus on.
Speaking at the colourful inauguration event, Defence Cabinet Secretary (CS) Eugene Wamalwa praised Kenyans for maintaining peace throughout the General Elections cycle.
Wamalwa urged incoming governors to safeguard the taxpayers’ money by ensuring completion of development projects left behind by their predecessors.
“I am pleading with incoming governors against abandoning projects started by their predecessors,” stated Wamalwa, adding such projects had already consumed a lot of funds by the government and development partners.
He cited the yet to be fully completed Trans Nzoia County Teaching and Referral Hospital and ultra-modern Kitale Business Centre.
Trans Nzoia County Commissioner Samson Ojwang, retired politician and former Agriculture Minister Dr Noah Wekesa were among senior officials who graced the occasion.

Governor Ntutu Commits To Improve Livelihoods

Incoming Narok County Governor Patrick Ntutu has committed to improve the livelihood of the people in the next 100 days by ensuring that the civil servants deliver proper and credible services to the residents.
Ntutu who spoke after he was sworn in office by High court Judge Justice Chacha Mwita at the William Ole Ntimama Stadium said he will personally move in all the villages in the county to identify the priority areas and give them a first chance in development.
Some of his top priorities include; fostering unity and cohesion in the county, promoting modern agriculture, ensuring easy access to clean water, ensuring quality and affordable health care and social protection, improving infrastructure and youth empowerment.
On health, Ntutu said he will visit all the health centers in the county to inspect the challenges in the specific facilities in a bid to improve the services rendered to Wananchi.
“I want to hear from the people the challenges they have in their local health centers and dispensaries. This will give me a clear picture on what to prioritize in the next five years,” he said.
On roads, the incoming governor promised to renovate all the feeder roads connecting to the markets so that farmers can transport their produce to the markets without any difficulties.
“I am aware that our county is very rich in agriculture, however, there has been a challenge of transportation because of impassable roads. In my administration, we will ensure that we mend the roads so that they become accessible to the residents,” he said.
At the same time, Ntutu promised to push for a legislation in the County Assembly that will introduce a Ward Development Fund, so as to bring services close to the people.
“The Ward Development Fund will be managed by the Members of County Assembly (MCA). They will put the money into boosting the welfare of their people in the grassroots,” he said.
Ntutu who once served as a District Commissioner (DC) promised to ensure all the money coming from Maasai Mara Game reserve is well utilised.
The incoming governor invited his main opponent Moitalel Ole Kenta (ODM) in his administration acknowledging that he too had a great manifesto that would help the people of Narok.
“The campaign season is now over; it is time we roll our sleeves to deliver services as we promised to the people of Narok. It is time we unite. I do not want to hear of any political differences,” said Ntutu.
Ntutu was installed the county Governor together with his Deputy Governor Koech Tamalinye in a ceremony witnessed by outgoing Narok Governor Samuel Tunai and outgoing deputy governor Ms. Evelyne Aruasa.
The occasion was attended by outgoing women representative Soipan Kudate and the incoming women representative Rebecca Tonkei.
Also in attendance were incoming Members of Parliament; Ken Aramat (Narok East), Kitilai Ntutu (Narok South), Gabriel Tongoyo (Narok West) and Johannah Ngeno (Emurua Dikirr).
Outgoing Kilgoris MP Gideon Konchella and Outgoing MP representing Persons living with disability David Sankok were also present.

Mbarire Promises Investors Business-Friendly Environment

Embu Governor Cecily Mbarire has pledged to create an enabling business environment for investors to invest in the county for employment and wealth creation.
The governor said her administration will make it easier and simpler for investors to get business licenses and permits for them to set up businesses in the county.
Speaking during her inauguration ceremony at Embu University, Mbarire said she will rationalise levies for different businesses and services in the county and ensure efficient revenue collection to seal all revenue leakages through digitization.
She expressed her confidence that digitization of revenue collection will seal revenue leakages in the county, adding that going forward her administration will not collect local revenue in cash.
The governor also promised to make Embu a tourism hub by using the experience she gained as an assistant minister in the Ministry of Tourism as part of the Mt Kenya tourism circuit.
“I will make Embu a tourism hub by using the experience I gained as an assistant minister. My government will develop different tourism products, among them the Mwea Game Reserve and the Irangi Forest Gate,” she said.
The governor also assured farmers that her government will ensure that agriculture is well enhanced through value addition, provision of markets for farm produce and provision of extension services to the farmers.
She further added that her administration will closely work with the National Government to provide affordable and accessible farm inputs, highly professional extension services and necessary legal frameworks to ensure guaranteed minimum returns for farmers.
Mbarire said that her government will staff, equip and provide necessary infrastructure in TVETS in order to enroll more youths in the institutions.
She pointed out challenges of understaffing that are experienced in devolved sector of Early Childhood Development and Education (ECDE) saying that her government will make sure that the challenges are solved.
